1.ACCEPTANCE OF TERMS
International Golden Heart Awards (IGHA) welcomes you. IGHA provides the IGHA Services (defined below) to you subject to the following Terms of Service (“TOS”) and Privacy Policy, which both may be updated by us from time to time without notice to you. By accessing and using the IGHA Services, you accept and agree to be bound by the terms and provision of the TOS.
2.DESCRIPTION OF IGHA SERVICES
IGHA is a unique Photography & Videography directory of some of the world’s best wedding photographers and filmmakers. IGHA also runs awards throughout the year. Each member is an independent business and therefore responsible for their services. It is recommended that you contact the photographer directly and perform due diligence prior to hiring. IGHA makes no guarantees of their performance, and is not responsible for their services. Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any services or information available through this website meet your specific requirements. Your hiring of foreign photographers and videographer companies is done entirely at your own risk.
3. NO COMMERCIAL REUSE OF IGHA PHOTOGRAPHERS SERVICES
You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion or use of, or access to, the IGHA (including Content, trademarks, and advertisements).
4. PRIVACY POLICY
The IGHA platform collects the following personal information provided in the act of joining: Name, email, address, work area, website, social networks, address and telephone number. Information is provided via filling out the application form / profile information and/or applying for membership.
The information provided may be used for the sending of emails, such as a newsletter, a release announcement and / or news related to IGHA or for information requested by the user. You may cancel your email signature at any time.
The information may be used to create your personal profile, promote your brand, promote the IGHA platform.
Confidential information, such as payment are only to be accessed by IGHA team and yourself. Employees may access your personal information, disclosure to third parties will not be performed without prior authorisation of the account holder who must provide the name and email of the person who will receive such information.
5. SECURITY
Our team of developers do their best to keep IGHA safe, but we can’t guarantee 100% security and like any online venture we are subject to risks.
6. CRITERIA FOR APPLICANTS
Becoming a member of IGHA requires approval from our team. The new members are submitted to a complete analysis through their website, where they are analysed technical questions, of photographic language, style, marketing, posture before the market, professional ethics, also must have a good website of good navigation that contains a good portfolio .
7. BENEFITS OF THE MEMBER
Every active member will have his / her full personal profile on our site, with presentation of the member’s portfolio as well as his / her brand and direct access to the member by clients and all site visitors, free entries in each prize round according to the regulations of each prize. Season winners will be filtered to a special section where all awarded photographs and videos will be displayed. All season winners will have direct access to a “Best of the Year Awards”.
Your profile can be found by direct search by states, country or your membership name and your award winning photos and your merits earned as a member of IGHA have been visible and prominent for as long as you remain an active member.
8. PAYMENT, CANCELLATION AND REFUND
The payment to become a member of International Golden Heart Awards is annual. Annual membership prices may change. For both annual membership or season awards, once payment is done, there is no right to request cancellation or reimbursement during the year. You may cancel auto-renewal yourself. You may also delete your profile. Note that deleting profile does not guarantee that if you come back to IGHA, your photos or awards are saved. You must be an active paying-member of the website in order to be considered for the award ceremonies.
9. CODE OF CONDUCT OF THE MEMBER
Members of IGHA are governed by the directory code of conduct. IGHA has the power in its sole and absolute discretion to exclude or suspend the affiliation of any member guilty of conduct that adversely affects the professional ethics or reputation of IGHA or its failure to comply with this Code of Conduct.
– As a condition of my participation in the INTERNATIONAL GOLDEN HEARTS AWARDS (IGHA), I agree to abide by this code of conduct, under the terms below:
Integrity
I undertake to observe the highest standards of honesty in all my transactions, avoiding the use of false, confusing, inaccurate and misleading terms, descriptions and claims in contracts or verbally. I will act fairly and faithfully with clients, employers, employees and other members. I will not claim any qualification, award, or certification that has not been properly achieved. I will not make any false statements about my application or relationship with IGHA.
Quality
At all times I will strive to produce photographs or videos of a quality equal to or greater than those presented in my portfolio sent at the time of application for IGHA.
Replacement
I will abide by the terms of the contract as to who will serve as the principal photographer or videographer at the wedding. I will not subcontract or assign my duties to another photographer or studio, unless expressly agreed in writing by the client.
Discretion
I will not, or will, permit, nationally or intentionally, publish or transmit a photograph of a sensitive nature on a public site or message board that may potentially harm or embarrass the client.
Responsibility and Copyrights
I solely and entirely accept the material and data submitted to IGHA as being true and of my own making.
I agree that all material submitted to IGHA will be duly authorized for image rights and will fully and completely exempt IGHA from any disagreement on this subject of third-party image rights.
I authorize IGHA to use, archive and publish on our website and social networks, in magazines, in book publications, in marketing campaigns and in any form of public display of any photo or video material I have sent to this directory, for all legal purposes of use of image and image right, at no cost for this, for an indefinite time.
I am aware that any image sent by me that for any reason has to be removed from the site and my portfolio, due to disagreement with third parties, will be my responsibility and if this image is a prize image, it will be disqualified and I will lose the prize any other benefit gained by this award, without prior notice, and will be subject to the code of conduct judgment of the directory.
Consumer Protection Code
I affirm that I have no pending complaints with at any municipal, state, national and even international level.
When you join, all members of IGHA must agree to abide by our Code of Conduct.
10. ACCESS
Access will be granted after payment is identified, access data will be sent via email, if it does not arrive immediately wait for a period of 72 hours and contact our team.
11. SUPPORT
Technical support is only available for members, and will be given through email during business hours, from 9am to 5pm Monday to Friday.
12. EXTRA TERMS AND CONDITIONS
By becoming a member of IGHA, members are fully aware that the system changes daily, with no prior notice being required before each change, unless we deem it necessary. The customer is also fully aware that there is a possibility of encountering “system bugs”, that is, process failures, as well as being slow and unable to use the system for a few hours or days.
13. MODIFICATIONS TO IGHA SERVICES
IGHA reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the IGHA Services (or any part thereof) with or without notice. You agree that IGHA shall not be liable to you or to any third party for any modification, suspension or discontinuance of the IGHA Services (or any part thereof).
14. LINKS
The IGHA Services may provide, or third parties may provide, links to other World Wide Web sites or resources to use any photographs of films that are part of the IGHA directory.. You acknowledge and agree that IGHA is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources.
15. LIMITATION OF LIABILITY
You expressly understand and agree that IGHA and its subsidiaries, affiliates, agents, employers, partners and licensors shall not be liable to you for any punitive, indirect, incidental, special, consequential, or exemplary damages.
16. TRADEMARK INFORMATION
You agree that all of IGHA trademarks, trade names, service marks and other IGHA logos and brand features, and product and service names are trademarks and the property of International Golden Heart Awards (IGHA2018). You need permission in order to use IGHA trademarks.
